Welcome to our online “Banksia Behaviour Practitioner Pathway Course” (the “Course”). By enrolling in and accessing this Course, you (the “Participant”) acknowledge that you have read, understood and agreed to abide by the terms and conditions set forth below (the “Terms”). These terms constitute a binding agreement between you and Banksia Support Services (“we”, “us” or “our”).

Enrolment and Registration:

1.1 Enrolment in the Course is subject to availability and completion of the registration process.

1.2 The participant must provide accurate and complete information during the registration process. Any falsified information may result in suspension or termination of the participant’s enrolment

1.3 By registering for the Course, the participant agrees to abide by these Terms and Conditions.

1.4 Upon enrolment, participants will receive access to Course materials, including handbooks, supplementary resources, and recorded video content. Access to these materials is provided for the duration as outlined in Section 2.

Course Structure and Duration:

2.1 The Course is delivered in a self-paced format, allowing participants to progress through the content at their own convenience within the allocated access period.

2.2 Participants will have access to Course materials for as long as the Course is live in the current version.

2.3 The Course does not include live sessions, but participants may have access to optional Q&A sessions or discussion forums, if applicable.

2.4 We reserve the right to update or modify Course materials as necessary to maintain relevance and quality.

Fees and Payment:

3.1 All payments shall be made in Australian Dollars and are GST inclusive.

3.2 There are 2 payment methods: full upfront payment or payment by instalment

3.3 For upfront payment, the total fee as advertised is payable upon registration.

3.4 For payment by instalments, the total fee as advertised shall be paid monthly in 6 equal instalments.

3.5 If you opt to pay by instalments, you agree that the instalment will be taken automatically on the nominated date each month for 6 months and that you will have sufficient funds available via your nominated payment method. Failure to make timely payment may result in the following actions:

  • Suspension of access to the Course until the outstanding payment is received
  • A late fee of $20 AUD may be applied to each overdue instalment
  • Repeated failure to pay may result in the debt being referred to a collection agency, and participants will be responsible for any associated collection fees or legal costs

Refunds and Cancellations:

4.1 Refunds shall not be provided for early withdrawal, change of mind or failure to complete the Course after registration has been completed and access to the Course has been granted. This includes where the option to pay by instalments has been made.

4.2 If you choose to pay by instalments, there is no option to pause or cancel payment once registration is complete and the instalment schedule has commenced.

Participant Responsibilities:

5.1 Participants are responsible for independently completing all Course materials.

5.2 Participants are expected to conduct themselves in a respectful manner in any associated discussion forums or online interactions. Disruptive or inappropriate behaviour may result in the removal of the Course without refund

Intellectual Property:

6.1 All Course materials, including but not limited to handbooks, presentations, videos, and exercises, remain the intellectual property of Banksia Support Services and may not be reproduced or distributed without express written permission from Banksia Support Services.

6.2 Participants may use Course materials solely for personal learning purposes and may not share or distribute access to the online materials to third parties.

Educational Purpose:

7.1 This Course is designed for educational purposes only and does not guarantee any specific job outcomes, professional licencing or endorsement as a Behaviour Support Practitioner

Liability:

8.1 Banksia Support Services shall not be liable for any injury, loss, or damage to participants or their property as a result of accessing or engaging with the Course, except in cases of gross negligence or wilful misconduct.

8.2 Participants acknowledge that they are responsible for their own learning experience and any actions they take based on the Course content.

Privacy Policy:

9.1 Banksia Support Services may collect personal information from participants for the purpose of registration, administration, and future promotions of the Course.

9.2 Participant information will be kept confidential and will not be shared with third parties except as required by law or with the participant's consent.

9.3 Any optional Q&A sessions or live workshops associated with the Course may be recorded for quality and improvement purposes. Recordings will be stored securely on Banksia Support Services’ encrypted cloud storage and will not be shared with participants.

Governing Law and Jurisdiction:

10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of NSW and Australia.

10.2 Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of NSW.

Amendments and Modifications:

11.1 Banksia Support Services reserves the right to amend or modify these Terms and Conditions at any time. Any changes will be communicated to participants in writing.

11.2 Participants’ continued access to the Course following any amendments or modifications constitutes acceptance of the revised Terms and Conditions.
